As an EU carrier, Lufthansa is covered in both directions: a delayed Chicago–Frankfurt flight is compensable under EU261 (€600, or €300 if you arrived less than 4 hours late), unlike the same route on United. Regional flights sold under LH numbers may be operated by Lufthansa CityLine, Air Dolomiti or Lufthansa City Airlines — all EU carriers. Flights from the UK to Germany on Lufthansa are covered by UK261 (£220/£350) with EU261 as an alternative basis.

Lufthansa’s “Passenger rights” page links to an online form for compensation and reimbursement. You need the booking code and the passenger’s surname. Lufthansa typically answers within 4–8 weeks and pays by bank transfer; it often first offers a voucher with a bonus, which you may decline in favour of cash.

  • Strikes — Lufthansa has faced pilot, cabin-crew and ground-staff strikes. Strikes by Lufthansa’s own staff are not extraordinary (Airhelp v SAS, Krüsemann). Strikes by airport staff or security screeners (for example Verdi strikes at Frankfurt or Munich airports) are external and usually are.
  • Weather in Frankfurt and Munich — winter storms are extraordinary where they genuinely prevented operations.
  • Technical faults — not extraordinary.

How long do I have to claim against Lufthansa?

For flights departing DE, a court claim is likely time-barred after 36 months (§§ 195, 199 BGB (three years from the end of the year in which the flight took place)). Other departure countries have their own limits; the airline's own claim form has no deadline of its own.

Lufthansa is a member of Schlichtungsstelle Reise & Verkehr (formerly söp), whose decisions are not binding on the airline. Refer the case there after a refusal or once the waiting period has passed; the enforcement body and the courts remain available.

What if Lufthansa says the delay was due to weather?

Weather can be an extraordinary circumstance — but only on the facts. Lufthansa must prove the conditions were incompatible with operating this flight, that they affected this flight and not just the airport in general, and that no reasonable measure could have avoided the delay. A generic reference to weather does not discharge that burden.

  • The burden of proof is on the airline (Art. 5(3)).
  • The weather must have affected this flight, not just the airport in general; other flights that operated are evidence.
  • The airline must also show what it did to avoid the disruption — spare aircraft, crew, re-routing.
  • A technical fault, by contrast, is inherent in normal operations and not extraordinary.
