If an airline rejects an EU261 or UK261 claim, the rejection does not decide the case. Whether the claim still stands depends on the reason the airline gave, the facts of the flight, the regulation that applies to it and whether the airline belongs to an ADR scheme. How the check works

  1. It resolves the regulation from the departure airport, the destination and the operating airline — the same rules the full check uses.
  2. It tests the airline's stated reason against the Regulation and the Court of Justice's case law, and reads the reply you paste (the text is analysed and discarded, never stored).
  3. It finds the ADR scheme, enforcement body and court for your airline and departure country from Horvera's verified registry, with the waiting periods and deadlines those bodies set.

What this check is — and is not

Horvera is a passenger-rights tool, not a law firm, a regulator, an ADR scheme or a court. The check is free, gives no guarantee of payment, and does not contact the airline. It tells you where the case stands and prepares the next step; the decision belongs to the airline, the ADR scheme, the enforcement body or the court.

Questions

Can an airline reject a valid EU261 claim?

Yes. A refusal is the airline's position, not a decision: nothing in Regulation 261/2004 makes it final. Under Article 5(3) the airline must prove an extraordinary circumstance for your flight, and the bodies that decide — approved ADR schemes, the national enforcement body and the courts — sit outside the airline.

Is the airline's reply I paste stored?

No. The text is read on the server to find the ground the airline relies on, the records it cites and what it leaves unanswered, and is then discarded. Only coded facts (the reason category, the regime) are counted for statistics.

Does Horvera contact the airline or file with the ADR scheme for me?

Not from this page. The check tells you where the case stands and which body can take it. The full check then writes your claim or your reply and prepares the file; you send it, in your name. Horvera is not a law firm, a regulator or an ADR scheme.
