Transavia compensation: claiming for delayed and cancelled Transavia flights

Check my flightAbout two minutes · no flight number needed

Quick answer

Transavia Airlines (Dutch licence, KLM group) and Transavia France (French licence, Air France group) are both EU carriers, so Regulation 261/2004 applies to every Transavia departure from the EU/EEA and every arrival into the EU. Amsterdam–Barcelona and Paris–Lisbon pay €250; Amsterdam–Málaga, Amsterdam–Faro and Paris–Tel Aviv pay €400. In the Netherlands you have only two years to sue.

Can Transavia passengers claim compensation?

Yes. Transavia holds a EU/EEA licence, so Regulation 261 covers its flights departing from the EU/EEA, the UK or Switzerland and its flights into them: €250–€600 per passenger for an arrival delay of 3 hours or more, a cancellation announced under 14 days ahead, or denied boarding — unless the airline proves an extraordinary circumstance.

What happened to your flight?

Which Transavia flew you

Flights on the HV code are operated by Transavia Airlines C.V. (Netherlands, bases Amsterdam, Rotterdam and Eindhoven); flights on the TO code by Transavia France S.A.S. (bases Paris Orly, Lyon, Nantes and others). Both are EU carriers with identical passenger rights, but they have separate claim channels and separate dispute bodies — check the code on your boarding pass.

How to claim from Transavia

Both airlines take claims through the service section of transavia.com (compensation for delay or cancellation), which routes the claim to the operating company. Provide the booking number, every passenger, flight number, date and arrival delay, and quote Article 7. Payment is by bank transfer; Transavia may offer a voucher first, which you can decline.

What Transavia typically argues

  • ATC restrictions — French ATC strikes and summer capacity restrictions over France and Spain are the most frequent cause; extraordinary only for the specific flight, and the airline must show its reasonable measures.
  • Late inbound aircraft — Transavia’s aircraft fly several Mediterranean rotations a day; knock-on delays are compensable unless the root cause was extraordinary.
  • Crew strikes by Transavia’s own staff — not extraordinary (Airhelp v SAS).
  • Technical problems — not extraordinary (Wallentin-Hermann).

Escalation

  • Transavia (HV): there is no Dutch aviation dispute-resolution scheme for standalone flights (the former Geschillencommissie Luchtvaart no longer exists). The ILT is the Dutch enforcement body; compensation itself is decided by the kantonrechter.
  • Transavia France (TO): Médiation Tourisme et Voyage (MTV) offers free mediation; the DGAC is the French enforcement body.
  • Court: the kantonrechter in the Netherlands or the tribunal judiciaire (small claims) in France, or the European Small Claims Procedure. Limitation: two years in the Netherlands (art. 8:1835 BW), five years in France.

Typical amounts

Amsterdam–Barcelona, Paris–Lisbon, Paris–Madrid and most sectors are under 1,500 km (€250). Amsterdam–Málaga, Amsterdam–Faro, Eindhoven–Alicante and Paris–Tel Aviv fall in the €400 band; Transavia flies no route over 3,500 km.

Can I claim compensation from Transavia?

Yes, if your Transavia flight arrived three hours or more late, was cancelled with less than 14 days' notice, or you were denied boarding against your will — and the airline cannot prove an extraordinary circumstance. EU261 applies because of the airline's licence and where the flight departed.

Conditions
  • Arrival at the final destination three hours or more after the scheduled time (delay).
  • Cancellation announced less than 14 days before departure, and no re-routing inside the legal time windows.
  • Confirmed booking, on-time check-in and boarding refused against your will.
  • The airline cannot prove an extraordinary circumstance it could not have avoided with all reasonable measures.

How much compensation does Transavia pay?

On the example routes for Transavia the fixed amount is 250 to 400 EUR per passenger, set by distance, regardless of the ticket price.

Conditions
  • Up to 1,500 km · 1,500–3,500 km · over 3,500 km; intra-EU flights over 3,500 km take the middle amount.
  • Over 3,500 km the airline may halve the amount if the arrival delay was under four hours.
  • Per passenger, for every passenger on the booking.

Which law applies to a Transavia flight?

Regulation (EC) No 261/2004 (EU261): Transavia is an EU/EEA-licensed carrier, so it applies to every flight departing the EU/EEA and to its flights into the EU/EEA from outside.

Conditions
  • Any flight departing the regime's territory is covered whichever airline operates it.
  • A flight into the territory from outside is covered only when a licensed carrier of that regime (or the EU) operates it.

How long do I have to claim against Transavia?

For flights departing NL, a court claim is likely time-barred after 24 months (Artikel 8:1835 Burgerlijk Wetboek (two years for claims arising from air carriage)). Other departure countries have their own limits; the airline's own claim form has no deadline of its own.

Conditions
  • The country whose enforcement body is competent — normally the departure country — sets the limit.
  • Limitation is national law (CJEU C-139/11); escalation steps do not stop the clock.

Where do I send a claim to Transavia?

Through the claim channel of Transavia: https://www.transavia.com/en-EU/service/. Claim from the operating carrier, in writing, and keep proof of sending.

Conditions
  • Claim from the airline that operated the flight (on the boarding pass), not necessarily the one that sold the ticket.
  • In writing, with the booking reference, flight number, date and the passengers' names; keep proof of sending.

What if Transavia refuses to pay?

No ADR scheme is on file for Transavia. After a refusal, complain to Human Environment and Transport Inspectorate (ILT) — the enforcement body of the departure country decides; a court claim remains available within the time limit.

Conditions
  • No fixed waiting period is published for this body; check its admissibility rules.
  • The national enforcement body of the departure country can examine the airline's compliance.
  • A court claim remains available within the national time limit, as a last resort.

What if Transavia says the delay was due to weather?

Weather can be an extraordinary circumstance — but only on the facts. Transavia must prove the conditions were incompatible with operating this flight, that they affected this flight and not just the airport in general, and that no reasonable measure could have avoided the delay. A generic reference to weather does not discharge that burden.

Conditions
  • The burden of proof is on the airline (Art. 5(3)).
  • The weather must have affected this flight, not just the airport in general; other flights that operated are evidence.
  • The airline must also show what it did to avoid the disruption — spare aircraft, crew, re-routing.
  • A technical fault, by contrast, is inherent in normal operations and not extraordinary.

Frequently asked questions

Is there a Dutch dispute-resolution body for Transavia claims?

No. The former Geschillencommissie Luchtvaart no longer exists, and the Geschillencommissie Reizen does not take complaints about standalone flights. After Transavia's answer, the Dutch routes are a complaint to the ILT (flights under one year old) and the kantonrechter.

How long do I have to claim against Transavia?

Two years from the flight in the Netherlands (art. 8:1835 BW) for Transavia (HV); five years in France for Transavia France (TO). The Dutch period is short — do not wait.

My Transavia France flight was cancelled because of a French ATC strike. Am I owed compensation?

ATC strikes are third-party action and usually extraordinary, so compensation is generally not due — but Transavia France must still refund or re-route you and provide care, and it must show it took all reasonable measures, including re-routing on another carrier.
