The continental sister airlines — TUI fly Belgium (TB), TUI fly Netherlands (OR) and TUI fly Deutschland (X3) — hold their own EU licences, have their own claim channels and fall under EU261; this page concerns TUI Airways.

How to claim from TUI Airways

TUI takes flight-compensation claims through the contact section of tui.co.uk (flight delay compensation form). Claim for every passenger on the booking, quote the flight number, date and arrival delay, and ask for payment by bank transfer. What if TUI Airways says the delay was due to weather?

Weather can be an extraordinary circumstance — but only on the facts. TUI Airways must prove the conditions were incompatible with operating this flight, that they affected this flight and not just the airport in general, and that no reasonable measure could have avoided the delay. A generic reference to weather does not discharge that burden.

  • The burden of proof is on the airline (Art. 5(3)).
  • The weather must have affected this flight, not just the airport in general; other flights that operated are evidence.
  • The airline must also show what it did to avoid the disruption — spare aircraft, crew, re-routing.
  • A technical fault, by contrast, is inherent in normal operations and not extraordinary.

My package holiday flight was delayed 5 hours. Can I claim both flight compensation and a holiday refund?

They are separate rights. Flight compensation is a UK261 claim against TUI Airways. A price reduction or damages for the holiday itself is a claim against the organiser under the Package Travel Regulations, and it must not duplicate the same loss.

Are TUI fly Belgium or TUI fly Netherlands flights covered by this page?
