Three easyJets

Since Brexit, easyJet holds three air operator certificates. Flights within the EU are generally operated by easyJet Europe (Vienna-registered), flights to and from the UK by easyJet UK, and flights from Switzerland by easyJet Switzerland (Geneva). All three are covered carriers, so the applicable regime follows the departure airport: EU261, UK261 or the Swiss application of the Regulation. The operating entity is printed on your boarding pass; it matters for flights into Europe from outside (for example from Egypt or Morocco), where only the covered entity triggers the rules.

How to claim from easyJet

easyJet’s help centre has a “Delays and cancellations” section with a compensation form (EU261/UK261). Log in with your booking reference and surname, select the disrupted flight, and add all passengers. easyJet usually replies within 2–4 weeks and tends to give the specific reason for the disruption, which makes its decisions easier to challenge when the reason is not extraordinary.

What easyJet typically argues

  • Weather at London Gatwick / Luton — genuinely extraordinary when it prevented operations, but easyJet must show the effect on your flight; check whether other airlines operated.
  • Crew out of hours — the airline’s responsibility; not extraordinary.
  • Knock-on delays — compensable unless the root cause was extraordinary and easyJet could not swap aircraft.
  • ATC strikes in France — usually extraordinary.

Escalation

  • UK departures: easyJet is a member of AviationADR, an ADR scheme approved by the CAA (it accepts easyJet flights with a UK or Swiss airport). Its decisions are binding on easyJet. Use it after a final refusal or 8 weeks without a substantive reply.
  • EU departures: the enforcement body of the departure country (e.g. DGAC in France, ENAC in Italy, AESA in Spain, apf in Austria for easyJet Europe complaints).
  • Swiss departures: FOCA.

easyJet is a member of AviationADR, whose decisions are binding on the airline. Refer the case there after a refusal or once the waiting period has passed; the enforcement body and the courts remain available.

What if easyJet says the delay was due to weather?

Weather can be an extraordinary circumstance — but only on the facts. easyJet must prove the conditions were incompatible with operating this flight, that they affected this flight and not just the airport in general, and that no reasonable measure could have avoided the delay. A generic reference to weather does not discharge that burden.

Conditions
  • The burden of proof is on the airline (Art. 5(3)).
  • The weather must have affected this flight, not just the airport in general; other flights that operated are evidence.
  • The airline must also show what it did to avoid the disruption — spare aircraft, crew, re-routing.
  • A technical fault, by contrast, is inherent in normal operations and not extraordinary.
