ITA Airways is licensed in Italy, so Regulation 261/2004 applies to all its departures from the EU/EEA and all its flights arriving in the EU from outside. Rome–London, Rome–Paris and Milan–Rome pay €250; Rome–Tel Aviv pays €400; Rome to New York, Boston, Miami, Tokyo or Buenos Aires pays €600. Flights operated by Alitalia before October 2021 are claims against Alitalia, not ITA.

Which ITA entity flew you

ITA Airways (Italia Trasporto Aereo S.p.A.) began operating in October 2021 with a new Italian operating licence; Lufthansa acquired a stake in 2025. It is not the legal successor of Alitalia for passenger claims: compensation for an Alitalia flight is a claim against Alitalia in extraordinary administration, whatever the flight number looked like. Everything flown on AZ numbers since 15 October 2021 is ITA.

How to claim from ITA

ITA handles claims through the support section of ita-airways.com (customer relations → passenger rights). Provide the booking code, every passenger’s name, flight number, date and arrival delay at your final destination, and quote Article 7 of Regulation 261/2004. Keep the acknowledgement; ITA answers in writing.

What ITA typically argues

  • ATC and airport restrictions — Italian ATC industrial action (short national strikes announced in advance) and summer slot restrictions at Rome Fiumicino and Milan. Third-party strikes are usually extraordinary; ITA must still show it took all reasonable measures, including re-routing you.
  • Late inbound aircraft — compensable unless the root cause was extraordinary.
  • Strikes by ITA’s own staff — not extraordinary (Airhelp v SAS).
  • Technical problems — not extraordinary (Wallentin-Hermann).

Escalation

  • ENAC (Ente Nazionale per l’Aviazione Civile) is Italy’s enforcement body: complain online for flights departing Italy after ITA refuses or stays silent for six weeks. ENAC can fine the airline; it does not order payment.
  • Flights departing another EU country: that country’s enforcement body.
  • Court: the Giudice di Pace (small claims) at your place of residence or the departure/arrival airport, or the European Small Claims Procedure. Italian courts commonly apply a two-year period to these claims — do not wait.

Typical amounts

Milan–Rome, Rome–London, Rome–Paris and the European network are under 1,500 km (€250). Rome–Tel Aviv and Rome–Cairo pay €400. Rome or Milan to New York, Boston, Miami, Los Angeles, São Paulo, Buenos Aires or Tokyo pays €600.

Can I claim compensation from ITA Airways?

Yes, if your ITA Airways flight arrived three hours or more late, was cancelled with less than 14 days' notice, or you were denied boarding against your will — and the airline cannot prove an extraordinary circumstance. EU261 applies because of the airline's licence and where the flight departed.

Conditions
  • Arrival at the final destination three hours or more after the scheduled time (delay).
  • Cancellation announced less than 14 days before departure, and no re-routing inside the legal time windows.
  • Confirmed booking, on-time check-in and boarding refused against your will.
  • The airline cannot prove an extraordinary circumstance it could not have avoided with all reasonable measures.

How much compensation does ITA Airways pay?

On the example routes for ITA Airways the fixed amount is 250 to 600 EUR per passenger, set by distance, regardless of the ticket price.

Conditions
  • Up to 1,500 km · 1,500–3,500 km · over 3,500 km; intra-EU flights over 3,500 km take the middle amount.
  • Over 3,500 km the airline may halve the amount if the arrival delay was under four hours.
  • Per passenger, for every passenger on the booking.

Which law applies to a ITA Airways flight?

Regulation (EC) No 261/2004 (EU261): ITA Airways is an EU/EEA-licensed carrier, so it applies to every flight departing the EU/EEA and to its flights into the EU/EEA from outside.

Conditions
  • Any flight departing the regime's territory is covered whichever airline operates it.
  • A flight into the territory from outside is covered only when a licensed carrier of that regime (or the EU) operates it.

How long do I have to claim against ITA Airways?

For flights departing IT, a court claim is likely time-barred after 24 months (Italian courts commonly apply the two-year Montreal Convention period (Art. 35) by analogy). Other departure countries have their own limits; the airline's own claim form has no deadline of its own.

Conditions
  • The country whose enforcement body is competent — normally the departure country — sets the limit.
  • Limitation is national law (CJEU C-139/11); escalation steps do not stop the clock.

Where do I send a claim to ITA Airways?

Through the claim channel of ITA Airways: https://www.ita-airways.com/en_en/support.html. Claim from the operating carrier, in writing, and keep proof of sending.

Conditions
  • Claim from the airline that operated the flight (on the boarding pass), not necessarily the one that sold the ticket.
  • In writing, with the booking reference, flight number, date and the passengers' names; keep proof of sending.

What if ITA Airways refuses to pay?

No ADR scheme is on file for ITA Airways. After a refusal, complain to Ente Nazionale per l'Aviazione Civile (ENAC) — the enforcement body of the departure country decides; a court claim remains available within the time limit.

Conditions
  • No fixed waiting period is published for this body; check its admissibility rules.
  • The national enforcement body of the departure country can examine the airline's compliance.
  • A court claim remains available within the national time limit, as a last resort.

What if ITA Airways says the delay was due to weather?

Weather can be an extraordinary circumstance — but only on the facts. ITA Airways must prove the conditions were incompatible with operating this flight, that they affected this flight and not just the airport in general, and that no reasonable measure could have avoided the delay. A generic reference to weather does not discharge that burden.

Conditions
  • The burden of proof is on the airline (Art. 5(3)).
  • The weather must have affected this flight, not just the airport in general; other flights that operated are evidence.
  • The airline must also show what it did to avoid the disruption — spare aircraft, crew, re-routing.
  • A technical fault, by contrast, is inherent in normal operations and not extraordinary.

Domande frequenti

Can I claim from ITA for an old Alitalia flight?

No. ITA Airways is a separate company that started flying on 15 October 2021 and did not take over Alitalia's passenger liabilities. Claims for Alitalia flights are against Alitalia in extraordinary administration.

Does ENAC make ITA pay?

ENAC assesses the complaint and can fine the airline, but it does not order payment to you. If ITA still refuses, the Giudice di Pace small-claims court or the European Small Claims Procedure is the route.

How long do I have to sue ITA in Italy?

Italian courts commonly apply a two-year period by analogy with the Montreal Convention. Treat two years from the flight as the safe limit and send the claim well before.
