Which ITA entity flew you
ITA Airways (Italia Trasporto Aereo S.p.A.) began operating in October 2021 with a new Italian operating licence; Lufthansa acquired a stake in 2025. It is not the legal successor of Alitalia for passenger claims: compensation for an Alitalia flight is a claim against Alitalia in extraordinary administration, whatever the flight number looked like. Everything flown on AZ numbers since 15 October 2021 is ITA.
How to claim from ITA
ITA handles claims through the support section of ita-airways.com (customer relations → passenger rights). Provide the booking code, every passenger’s name, flight number, date and arrival delay at your final destination, and quote Article 7 of Regulation 261/2004. Keep the acknowledgement; ITA answers in writing.
What ITA typically argues
- ATC and airport restrictions — Italian ATC industrial action (short national strikes announced in advance) and summer slot restrictions at Rome Fiumicino and Milan. Third-party strikes are usually extraordinary; ITA must still show it took all reasonable measures, including re-routing you.
- Late inbound aircraft — compensable unless the root cause was extraordinary.
- Strikes by ITA’s own staff — not extraordinary (Airhelp v SAS).
- Technical problems — not extraordinary (Wallentin-Hermann).

How much compensation does ITA Airways pay?

Which law applies to a ITA Airways flight?
Regulation (EC) No 261/2004 (EU261): ITA Airways is an EU/EEA-licensed carrier, so it applies to every flight departing the EU/EEA and to its flights into the EU/EEA from outside.

How long do I have to claim against ITA Airways?
For flights departing IT, a court claim is likely time-barred after 24 months (Italian courts commonly apply the two-year Montreal Convention period (Art. 35) by analogy). Other departure countries have their own limits; the airline's own claim form has no deadline of its own.

What if ITA Airways says the delay was due to weather?
Weather can be an extraordinary circumstance — but only on the facts. ITA Airways must prove the conditions were incompatible with operating this flight, that they affected this flight and not just the airport in general, and that no reasonable measure could have avoided the delay. A generic reference to weather does not discharge that burden.

Can I claim from ITA for an old Alitalia flight?
No. ITA Airways is a separate company that started flying on 15 October 2021 and did not take over Alitalia's passenger liabilities. Claims for Alitalia flights are against Alitalia in extraordinary administration.
Does ENAC make ITA pay?
ENAC assesses the complaint and can fine the airline, but it does not order payment to you. If ITA still refuses, the Giudice di Pace small-claims court or the European Small Claims Procedure is the route.
