TAP Air Portugal is licensed in Portugal, so Regulation 261/2004 covers all TAP flights departing the EU/EEA and all TAP flights arriving in the EU from outside it — including its Brazilian, North American and African routes. Long-haul via Lisbon pays €600; most European sectors pay €250, with Lisbon–London and Lisbon–Dublin in the €400 band.

Which TAP entity flew you
TAP Air Portugal S.A. holds a Portuguese operating licence. Shorter domestic and European flights sold as TAP Express are operated by Portugália Airlines (NI), also Portuguese; a small number of regional flights have been wet-leased to other European carriers. Every one of these is an EU carrier, so your rights are the same whichever aircraft turned up — address the claim to TAP, which handles claims for the group.
How to claim from TAP
TAP takes compensation claims through the customer support section of flytap.com (contact form, choose the passenger-rights topic) and in writing. Submit one claim per booking, listing every passenger, the flight number, the date and the delay at your final destination, and quote Article 7 of Regulation 261/2004. TAP normally asks for the booking code and, for long-haul connections, the full itinerary; keep the automatic acknowledgement.
What TAP typically argues
- Lisbon hub congestion and ATC — Lisbon Airport runs close to capacity and Portuguese air-traffic-control staffing restrictions are common in summer. ATC restrictions can be extraordinary, but only for your specific flight and only if TAP shows what it did about them.
- Late inbound aircraft — TAP’s long-haul aircraft rotate through Lisbon; a late arrival from São Paulo delays the onward European sector. A knock-on delay is compensable unless the original cause was itself extraordinary (Wallentin-Hermann; the Commission’s 2016 guidelines).
- Technical problems — not extraordinary in principle (Wallentin-Hermann, van der Lans).
- Connections — for a single booking through Lisbon, the delay that counts is the arrival at your final destination (Folkerts), even if the first sector was on time.
Escalation
- ANAC (Autoridade Nacional da Aviação Civil) is Portugal’s enforcement body: complain there for flights departing Portugal after TAP refuses or stays silent. Portugal has no binding sector-specific ADR scheme; consumer arbitration centres can hear the dispute if TAP agrees.
- Flights departing another EU country: that country’s enforcement body (the LBA in Germany, DGAC in France, AESA in Spain).
- Court: the Portuguese julgados de paz for small claims, or the European Small Claims Procedure for cross-border claims up to €5,000.
Typical amounts
Lisbon–Madrid, Lisbon–Paris, Porto–Lisbon and most European sectors are under 1,500 km (€250). Lisbon–London and Lisbon–Dublin cross 1,500 km (€400). Lisbon to New York, Newark, São Paulo, Rio, Luanda or Maputo pays €600, halved to €300 when TAP re-routes you to arrive under 4 hours late.

Can I claim compensation from TAP Air Portugal?
Yes, if your TAP Air Portugal flight arrived three hours or more late, was cancelled with less than 14 days' notice, or you were denied boarding against your will — and the airline cannot prove an extraordinary circumstance. EU261 applies because of the airline's licence and where the flight departed.
- Conditions
- Arrival at the final destination three hours or more after the scheduled time (delay).
- Cancellation announced less than 14 days before departure, and no re-routing inside the legal time windows.
- Confirmed booking, on-time check-in and boarding refused against your will.
- The airline cannot prove an extraordinary circumstance it could not have avoided with all reasonable measures.

- Conditions
- Any flight departing the regime's territory is covered whichever airline operates it.
- A flight into the territory from outside is covered only when a licensed carrier of that regime (or the EU) operates it.

How long do I have to claim against TAP Air Portugal?
The time limit is set by the national law of the departure country and differs by country; no reviewed period is on file for PT. Claim promptly — the airline's form has no deadline, but the courts do.

- Conditions
- No fixed waiting period is published for this body; check its admissibility rules.
- The national enforcement body of the departure country can examine the airline's compliance.
- A court claim remains available within the national time limit, as a last resort.

What if TAP Air Portugal says the delay was due to weather?
Weather can be an extraordinary circumstance — but only on the facts. TAP Air Portugal must prove the conditions were incompatible with operating this flight, that they affected this flight and not just the airport in general, and that no reasonable measure could have avoided the delay. A generic reference to weather does not discharge that burden.
- Conditions
- The burden of proof is on the airline (Art. 5(3)).
- The weather must have affected this flight, not just the airport in general; other flights that operated are evidence.
- The airline must also show what it did to avoid the disruption — spare aircraft, crew, re-routing.
- A technical fault, by contrast, is inherent in normal operations and not extraordinary.

Questions fréquentes
My TAP flight from Brazil to Lisbon was delayed. Does EU261 apply?
Yes. TAP is an EU carrier, so its flights arriving in the EU from outside are covered, even though the departure airport is not in the EU. A delay of 3 hours or more at your final destination pays €600 unless TAP proves extraordinary circumstances.
I missed my TAP connection in Lisbon. Who do I claim from?
If both flights were on one booking, TAP owes compensation based on the arrival delay at your final destination, whichever sector caused the missed connection. Claim once, for the whole itinerary, through TAP customer support.
Where do I escalate a TAP refusal?
For flights departing Portugal, complain to ANAC, the Portuguese enforcement body. Portugal has no binding aviation ADR scheme; for a cross-border claim the European Small Claims Procedure is the practical court route.
