Which TUI flew you
TUI Airways Limited (UK licence, code BY) operates the UK holiday flights from Gatwick, Manchester, Birmingham, Bristol, Glasgow and other UK airports. The continental sister airlines — TUI fly Belgium (TB), TUI fly Netherlands (OR) and TUI fly Deutschland (X3) — hold their own EU licences, have their own claim channels and fall under EU261; this page concerns TUI Airways.
How to claim from TUI Airways
TUI takes flight-compensation claims through the contact section of tui.co.uk (flight delay compensation form). Claim for every passenger on the booking, quote the flight number, date and arrival delay, and ask for payment by bank transfer. If you booked a TUI package holiday, the compensation claim for the flight is still a UK261 claim against TUI Airways as operating carrier; refunds or price reductions for the holiday itself follow the Package Travel Regulations 2018 and are a separate request to TUI as organiser.
What TUI typically argues
- Late inbound aircraft — TUI’s long-haul aircraft fly out and back; a delay leaving the Caribbean arrives with the same aircraft in the UK. Compensable unless the original cause was extraordinary.
- ATC and airport restrictions — extraordinary only if shown for your flight.
- Weather at the destination (hurricane season in the Caribbean, winter in the UK) — must have affected your flight and the airline must have taken all reasonable measures.
- Technical problems — not extraordinary (Wallentin-Hermann, applied by UK courts).
Escalation
- AviationADR — TUI Airways is a member of the AviationADR scheme; its decisions bind the airline. Refer the case after TUI’s final response or 8 weeks of silence; free for passengers.
- Return flights departing an EU airport are also covered by EU261, so the enforcement body of that country is an alternative route.
- Court: small-claims track in England and Wales, simple procedure in Scotland. Limitation: six years (five in Scotland).
Typical amounts
Gatwick–Palma and the shortest Spanish routes are under 1,500 km (£220). Manchester–Tenerife, Birmingham–Tenerife and the Greek, Turkish and Egyptian routes are between 1,500 and 3,500 km (£350). Gatwick–Orlando, Manchester–Cancún, Gatwick–Barbados and the other long-haul holiday routes pay £520 (£260 if re-routed to arrive under 4 hours late).

Can I claim compensation from TUI Airways?
Yes, if your TUI Airways flight arrived three hours or more late, was cancelled with less than 14 days' notice, or you were denied boarding against your will — and the airline cannot prove an extraordinary circumstance. UK261 applies because of the airline's licence and where the flight departed.
- Conditions
- Arrival at the final destination three hours or more after the scheduled time (delay).
- Cancellation announced less than 14 days before departure, and no re-routing inside the legal time windows.
- Confirmed booking, on-time check-in and boarding refused against your will.
- The airline cannot prove an extraordinary circumstance it could not have avoided with all reasonable measures.

How much compensation does TUI Airways pay?
On the example routes for TUI Airways the fixed amount is 220 to 520 GBP per passenger, set by distance, regardless of the ticket price.
- Conditions
- Up to 1,500 km · 1,500–3,500 km · over 3,500 km; intra-EU flights over 3,500 km take the middle amount.
- Over 3,500 km the airline may halve the amount if the arrival delay was under four hours.
- Per passenger, for every passenger on the booking.

Which law applies to a TUI Airways flight?
UK261 — Regulation 261/2004 as retained in UK law: TUI Airways is a UK-licensed carrier, so it applies to every flight departing the UK and to its flights into the UK. EU261 applies instead to its flights departing the EU.
- Conditions
- Any flight departing the regime's territory is covered whichever airline operates it.
- A flight into the territory from outside is covered only when a licensed carrier of that regime (or the EU) operates it.

How long do I have to claim against TUI Airways?
For flights departing GB, a court claim is likely time-barred after 72 months (Limitation Act 1980, s. 5 (England and Wales; six years). Scotland: five years under the Prescription and Limitation (Scotland) Act 1973.). Other departure countries have their own limits; the airline's own claim form has no deadline of its own.
- Conditions
- The country whose enforcement body is competent — normally the departure country — sets the limit.
- Limitation is national law (CJEU C-139/11); escalation steps do not stop the clock.

Where do I send a claim to TUI Airways?
Through the claim channel of TUI Airways: https://www.tui.co.uk/destinations/contact-us. Claim from the operating carrier, in writing, and keep proof of sending.
- Conditions
- Claim from the airline that operated the flight (on the boarding pass), not necessarily the one that sold the ticket.
- In writing, with the booking reference, flight number, date and the passengers' names; keep proof of sending.

What if TUI Airways refuses to pay?
TUI Airways is a member of AviationADR, whose decisions are binding on the airline. Refer the case there after a refusal or once the waiting period has passed; the enforcement body and the courts remain available.
- Conditions
- The body accepts the case 56 days after the claim was sent without a substantive answer, or after a final refusal.
- The national enforcement body of the departure country can examine the airline's compliance.
- A court claim remains available within the national time limit, as a last resort.

What if TUI Airways says the delay was due to weather?
Weather can be an extraordinary circumstance — but only on the facts. TUI Airways must prove the conditions were incompatible with operating this flight, that they affected this flight and not just the airport in general, and that no reasonable measure could have avoided the delay. A generic reference to weather does not discharge that burden.
- Conditions
- The burden of proof is on the airline (Art. 5(3)).
- The weather must have affected this flight, not just the airport in general; other flights that operated are evidence.
- The airline must also show what it did to avoid the disruption — spare aircraft, crew, re-routing.
- A technical fault, by contrast, is inherent in normal operations and not extraordinary.

Questions fréquentes
Is TUI Airways a member of an ADR scheme?
Yes — AviationADR. After TUI's final response, or after 8 weeks without one, you can refer the case; the decision binds the airline and the scheme is free for passengers.
My package holiday flight was delayed 5 hours. Can I claim both flight compensation and a holiday refund?
They are separate rights. Flight compensation is a UK261 claim against TUI Airways. A price reduction or damages for the holiday itself is a claim against the organiser under the Package Travel Regulations, and it must not duplicate the same loss.
Are TUI fly Belgium or TUI fly Netherlands flights covered by this page?
Those are separate EU carriers with their own claim channels. Their flights are covered by EU261 in the same way; address the claim to the operating airline named on your boarding pass.
